These Terms govern your access to and use of ReachFlux. Please read them carefully before using the Service.
Summary: By accessing or using ReachFlux, you agree to these Terms of Service and our Privacy Policy.
These Terms of Service ("Terms") govern your access to and use of ReachFlux and its related websites, applications, features, and services (collectively, the "Service").
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms.
If you use ReachFlux on behalf of a business or other organization, you represent that you have authority to accept these Terms on its behalf.
If you do not agree to these Terms, you must not use the Service.
ReachFlux is a software-as-a-service platform designed to help businesses manage email outreach, prospects, campaigns, replies, sales workflows, analytics, and related automation.
Depending on your plan and available functionality, the Service may include:
Features may be added, changed, improved, restricted, or discontinued as the Service develops.
You must provide accurate and reasonably complete information when creating and maintaining your ReachFlux account.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity performed through your account.
You agree to:
You may not create or operate accounts for the purpose of bypassing subscription limits, enforcement actions, sending restrictions, security controls, or other Service limitations.
Prohibited: ReachFlux may not be used for spam, phishing, harassment, deception, fraud, unlawful messaging, or other illegal or abusive activity.
You must not use ReachFlux to:
We may investigate suspected abuse and may restrict or suspend accounts, campaigns, integrations, or other functionality when reasonably necessary to protect ReachFlux, its users, third parties, or the integrity of the Service.
You are responsible for the recipients, content, targeting, legal basis, and other aspects of communications sent through or with the assistance of ReachFlux.
You are responsible for determining and complying with laws and regulations applicable to your outreach activities, which may include email marketing, privacy, electronic communications, data protection, and anti-spam requirements.
Depending on the jurisdiction and type of communication, these requirements may include:
ReachFlux may provide tools intended to help users manage unsubscribe requests, suppression information, sending activity, and other compliance-related workflows.
These tools do not constitute legal advice and do not guarantee that a user's campaigns comply with every law applicable to that user or recipient.
ReachFlux may allow you to connect third-party services, including email providers, calendar services, AI providers, and other integrations.
Your use of a third-party service remains subject to that provider's own terms, policies, limitations, and availability.
You are responsible for maintaining authorization to use accounts and services you connect to ReachFlux.
ReachFlux is not responsible for outages, restrictions, suspensions, policy changes, or other actions taken by third-party providers.
ReachFlux may provide optional AI-assisted features such as email drafting, conversation analysis, suggested actions, automated workflow decisions, and related functionality.
AI-generated or AI-assisted output may be inaccurate, incomplete, inappropriate, or unsuitable for a particular situation.
You are responsible for reviewing and determining the suitability of AI-assisted output and for configuring automation features appropriately for your use case.
ReachFlux does not guarantee the accuracy, performance, availability, or results of AI-generated content or automated decisions.
Certain ReachFlux functionality requires a paid subscription. Available plans, prices, billing intervals, limits, and included features are displayed on the applicable pricing or checkout page.
If you purchase a recurring subscription, you authorize recurring charges according to the billing interval shown at checkout until the subscription is cancelled or otherwise terminated.
Payments may be processed by an authorized third-party payment provider or Merchant of Record.
Additional payment-provider terms, tax treatment, billing rules, or checkout conditions may apply to a transaction and will be presented where applicable.
Applicable taxes may be calculated, collected, or handled by the applicable payment provider or Merchant of Record according to the transaction, customer location, and applicable requirements.
Available upgrade, downgrade, renewal, and cancellation options may depend on the subscription and billing provider. Any applicable pricing or billing effect will be displayed where reasonably practicable before confirmation.
If a recurring payment cannot be successfully processed, access to paid functionality may be restricted, downgraded, suspended, or terminated after applicable payment recovery attempts.
You may cancel a recurring ReachFlux subscription using available account or billing-management functionality, or by contacting support@reachflux.io.
Unless otherwise stated at checkout, cancellation normally prevents future renewals rather than automatically refunding amounts already paid.
Refund eligibility is governed by our Refund Policy, applicable law, and any mandatory consumer rights that apply.
The ReachFlux software, website, interface, branding, designs, documentation, and other materials provided by ReachFlux are protected by applicable intellectual property laws.
Subject to these Terms, ReachFlux grants you a limited, non-exclusive, non-transferable right to access and use the Service for your lawful business purposes.
As between you and ReachFlux, you retain ownership of content and data you provide to ReachFlux, subject to rights held by other parties.
You grant ReachFlux the limited rights reasonably necessary to host, process, transmit, display, and otherwise handle that content for the purpose of providing and operating the Service.
If you voluntarily provide suggestions or feedback about ReachFlux, we may use that feedback to develop and improve the Service without an obligation to compensate you.
Your use of ReachFlux involves information that you upload, import, create, receive, or process through the Service.
You represent that you have the rights and permissions reasonably necessary to provide and process such information through ReachFlux.
Our collection and processing of personal information is further described in our Privacy Policy.
You are responsible for maintaining copies or backups of information where appropriate for your business.
You may stop using ReachFlux at any time and may cancel an active recurring subscription using available billing controls or by contacting support@reachflux.io.
We may restrict, suspend, or terminate access where reasonably necessary, including when we believe:
Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct a violation. Serious abuse, fraud, security threats, or unlawful activity may result in immediate action.
Following termination, access to some or all account functionality may cease. Certain information may be retained where reasonably necessary for legal, security, fraud prevention, accounting, or legitimate business purposes, as described in our Privacy Policy.
ReachFlux is provided on an "as available" and "as is" basis to the extent permitted by applicable law.
We do not guarantee that the Service will always be uninterrupted, error-free, or available.
ReachFlux does not guarantee:
Results may depend on factors outside ReachFlux's control, including sender reputation, recipient behavior, email provider policies, DNS configuration, content, third-party services, and user activity.
To the maximum extent permitted by applicable law, ReachFlux will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or relating to use of the Service.
To the maximum extent permitted by applicable law, ReachFlux's aggregate liability arising from or relating to the Service will not exceed the amount paid by you for the Service during the twelve months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold ReachFlux harmless from claims, losses, liabilities, and reasonable expenses arising from:
These Terms and disputes relating to ReachFlux are subject to applicable law and any mandatory rights or jurisdictional requirements that cannot lawfully be excluded by agreement.

When updated, the "Last updated" date will be revised. Where appropriate, material changes may also be communicated through the Service or by email.
Your continued use of ReachFlux after updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.
